Important: By accessing or using OccaServe, you agree to be bound by these Terms of Service. If you do not agree to all terms, please do not use our platform.
These Terms of Service ("Terms") constitute a legally binding agreement between you and OccaServe. By creating an account or using any part of our platform, you agree to be bound by these Terms.
You must be at least 18 years old and capable of entering into a legally binding contract under Philippine law to use OccaServe. By using our platform, you represent that you meet these requirements.
OccaServe is a technology platform that connects customers seeking catering services with independent catering professionals ("Caterers"). OccaServe is not a catering company itself.
Caterers listed on OccaServe are independent contractors, not employees, agents, or partners of OccaServe.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your account credentials.
You may not create accounts for others without permission, impersonate any person or entity, or use another user's account.
OccaServe reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm the platform or its users.
When a booking is confirmed, a contract is formed between the customer and the caterer. OccaServe facilitates but is not a party to this contract.
All payments are processed by PayMongo. By making a payment, you agree to PayMongo's terms of service. OccaServe collects payment on behalf of caterers and remits funds after service completion.
Cancellation and refund terms are set by individual caterers and displayed on their profiles. OccaServe will mediate good-faith disputes between parties.
OccaServe charges caterers a service fee on completed bookings. This fee is deducted from the caterer's payout and is disclosed during caterer onboarding.
Caterers must ensure that all information in their profile—including menus, pricing, availability, and service areas—is accurate and up to date.
Caterers agree to deliver the agreed-upon services professionally, on time, and to the standard described in their booking agreement.
Caterers are responsible for complying with all applicable Philippine laws, including food safety regulations, business permits, and tax obligations.
Users may not: (a) conduct transactions outside the platform to circumvent fees; (b) post false reviews; (c) harass or threaten other users; (d) upload malicious code; (e) violate any applicable law through use of OccaServe.
OccaServe is not liable for the quality, safety, or legality of catering services provided by Caterers. Our liability to you shall not exceed the amount of fees paid to OccaServe in the 3 months prior to the claim.
OccaServe does not guarantee uninterrupted access to the platform and is not liable for downtime, data loss, or technical failures.
These Terms shall be governed by the laws of the Republic of the Philippines. Any disputes shall be subject to the exclusive jurisdiction of the courts of Metro Manila.
